“固有先占原则”，我这怎么修改呢？

请教个问题：美国初审意见中，对比文件公开了XX可降血糖，我的权1和2是请求保护XX制备降血糖药物的用途，权3是请求保护XX制备降血脂药物的用途，审查员说权1-3都没有新颖性。权1-2没有新颖性好理解，为什么权3也没有新颖性呢？审查意见中还提到了“固有先占原则”，大致意思是固有属性并不具备新颖性，因而也不具有可专利性。
哪位可以帮我解释下，我该怎么答复呢，把权3修改为治疗方法是否能克服缺陷呢？

消灭零回复，这种情况遇到过一次
The discovery of a new use for an old structure based on unknown properties of the structure might be patentable to the discoverer as a process of using. However, when the claim recites using an old composition or structure and the “use” is directed to a result or property of that composition or structure, then the claim is anticipated. In reMay, 574 F.2d 1082, 1090, 197 USPQ 601, 607 (CCPA 1978)
所以，如果驳回是基于102，那么仅仅把主题改成治疗方法是没有什么用的。但是，如果在权3加入其它条件或环境特征，避免对比文件discloses every limitation recited in the claims，那么审查员想要基于103驳回的难度就比102大得多了，因为在103上，类似于teach away这种理由就可以生效。
