embodiment or example?

据我所了解，美国通常会用embodiment代表实施例，刚看到你的帖子，去查了下MPEP.在600那章找到以下段落：
Specific operative embodiments or examples of the invention must be set forth. Examples and description should be of sufficient scope as to justify the scope of the claims.  (600-93 Rev.7, July 2008)

所以我想应该就字面意义而言两个都可以，只是美国比较常用EMBODIMENT.

然后，我查了下 Patent it yourself 这本书，在13TH Edtion  196页找到，如下描述：
j. DETAILED DESCRIPTIO*****PA—First
Embodiment—Figures 1-xx
Here you should describe in great detail the static physical
structure of the first embodiment of your invention (not
how it operates or what its function is). If this embodiment
is a process, describe the procedures or machinery involved
in it. Begin by first stating what the figure under discussion
shows generally—for example, “Fig 1 shows a perspective
view of a one version of my widget.” Then get specific by
describing the main parts and how they’re connected.
(These main parts can form the basis for your claims, as
we’ll see in Chapter 9.) Then get more specific: Describe
each main part in detail and all of the sub- or component
parts in detail.
并且我大致搜索了一下，基本上实施例都是用"embodiment"表示的~

最后，我看了一下The complete patent book, 全文有关实施例的单词都是用的'EMBODIMENT"，只有在举例的时候用的“example"。所以我认为，美国应该是偏向用'embodiment"来表示实施例，即整个实施方案。

总体比较混乱。
欧洲caselaw习惯：prior art里面是example, application里面是embodiment
不过也不是区分的特别严格，case law里面偶尔也有用混的。

按照EPC的用法，embodiment似乎指claims里面定义的。比如R43(3)

(3) Any claim stating the essential features of

an invention may be followed by one or more

claims concerning particular embodiments of

that invention.
example的话，是description里面真正的具体例子。比如R42(1)(e)
(1) The description shall:

...

(e)describe in detail at least one way of carrying

out the invention claimed, using examples

where appropriate and referring to the drawings,

if any;

工作里看到的还主要是caselaw的习惯

     你最后一句让我糊涂了，“实施例，即整个实施方案”。

     根据您的分析，我理解embodiment类似于发明或者实用新型的“技术方案”，而example应该是具体实施方式中的实施例。

技术方案是technical solution，不是embodiment。embodiment是申请里的实施例，example是对比文件里的实施例。因为出发的角度不同，所以叫不一样的东西。
