三体人:我懂了,你们地球人居然“想”和“说”不是一回事,这真是地球人进化中最大的缺陷。

伊文思:主啊,这恰恰是我们人类最大的优势。








如果人的思维能通过信号直接传递,那么估计也省了律师的一大半力气,审案子只要把诉讼双方脑子里知道的那些事实往陪审团脑子里一传输就可以了,陪审团心里头怎么想对大家也都是透明的,不用去猜。

但我们地球人比这个先进。我们是靠表达和理解(也就是上一部分说的调制和解调)来传递信息的,所以律师对客户的助力(Advocacy)还是对案件的结果起着至关重要的作用。

经常有朋友问我,你们律师是怎么把黑说成白的?我的回答是:我们不能。

没有事情是完全的黑或者完全的白,能告上法庭的事情,恐怕更不会有非黑即白的存在。在有限的证据下,我们能看到的都是灰,问题只是哪一度的灰(different shades of gray),我们律师不能够颠倒黑白,我们的工作是把事实那度灰渲染的更接近黑色,或者更接近白色。

案子最终的输赢在于陪审团心里觉得那是深灰还是浅灰。

技术层面


技术层面是说present证据的技巧和策略,比如trial中order of presenting information是很重要的,先让什么证人出场,对每个证人先让他把什么证据给出来,都是很有讲究的,有些重要证据最好用别的信息先做铺垫,这样陪审团听到这个重要信息的时候才能按你这一方想要他理解的方式来理解,也就是先塑造好context。

在direct examination不能lead证人的情况下如何合理的引导证人给出需要的证据也是技术活,问题问的清楚,给出必要的信号,都能够帮助证人配合律师想要的方向给出答案,比如如果律师问What happened between you and XXX? 证人可能不知所措,他们之间可以发生很多事情,证人不知道律师想他说什么,说哪个时段的事情。有时候为了给证人一点hint,先问一个leading的问题,来给证人传递信号,也不失是一个策略,等对方object,就再问回5个W1个H,证人就已经知道你要他说什么了。

Cross examination怎么来设计问题,让证人没有选择,必须给出yes或者no的答案,也相当需要经验。我们通常会把一个line of questioning分成很多个小问题,每一个小问题都有唯一的答案,证人没法有发挥的空间,而这些小问题层层推进,把证人逼入死角。有时候太急于求成,过早去追求那个想要的结论,可能会使得问题太过宽泛或者主观,证人可以找到机会躲避明确的答案,而开始自己的长篇大论。举个例子,商业秘密案件,如果你问Company B的证人,Company B copied company A’s source code, do you agree? 证人肯定会说不是,因为他可以对copy这个词有不同的理解,把问题**(break down),效果就会好很多:

Counsel: Sir, please take a look at Exhibit A and Exhibit B.  Exhibit A is the source code used by companyB’s product model XXX, correct?

Witness: yes.

Counsel: I represent to you that Exhibit B shows a source code created by company A.  Now is the first line of Exhibit A identical to first line of Exhibit B?

Witness: looks identical to me.

Counsel: Is the second line of Exhibit A identical to second line of Exhibit B?

Witness: sure.
. . . . . .

Counsel: You just compared the first 10 lines of Exhibit A to those of Exhibit B, and they all look the same?

Witness: I guess yes.

要不要re-direct又是另一个策略问题,需要律师仔细的听对方的cross examination,并且对cross产生的影响做出及时准确的判断,看有没有什么事情是需要澄清的,通常来讲,让证人“结束”在自己手里是常见的作法,就是说陪审团听到的这个证人的最后的证词是你引导他说的有利于本方的证词。

心理层面

Good arguments can only convince those with listening ears (雄辩要说服人必须要有愿听的耳朵)。策略再好,说得再眉飞色舞,陪审团不信你也是白搭,而要陪审团信你,最重要的是让自己变得可信(creditable)。毕竟很多案子,陪审员的背景决定了无论你说什么他们可能都没法真正理解,比如我们专利案,陪审团真的明白电压反馈和电流反馈的区别吗?他们只能选择谁可信,然后接受他的说法。

之前说到的“共振”,信任是让陪审团与律师产生共振的基础,一旦产生共振,信息就自动被放大,说到陪审团的“心”里去。反过来,如果陪审团对律师产生不信任,比如他们觉得律师在骗人,那么别说共振,陪审团可能会直接关掉接收器,认为你说什么都不用听了。用法律的语言讲,jury作为fact finder可以自行决定给证据以权重,他认为不可信的证据,可以assign minimum weight or even no weight。

可是陪审员与律师互不认识,怎么来建立信任呢?简单的说,还是透过律师的言行举止。长相是第一印象,精神奕奕的白发老爷爷往哪儿一站就让人觉得可靠,身材姣好的金发美女一起身就让人觉得女神驾到,这个说法是有很多jury consultant的研究支持的。那如果长相一般的你我要怎么办呢?穿的得体也能体现自己的专业和对陪审员的尊重。女律师经常要琢磨是穿裤子好呢还是穿裙子,这个跟当地文化有关,如果不确定那个法院所在地的开放程度,裤子还是比较**,另外,那双镶钻的恨天高最好不要出庭穿。有位女法官曾当庭跟我们讲,下次穿盖过膝盖的短裙再来。








除了这些第一印象之外,信任感就来自律师的表达了,可以说技术层面关注的是说什么,心理层面关注的则是怎么说,用什么样的措辞,说话的语速,一个眼神,甚至不经意的手势都透露着律师的信心,而陪审员就是通过观察这种信心,来判断律师真的是有一个strong case,还是在虚张声势,误导自己。

我知道有很多律师是可以argue自己心里不信的东西的,他们的理论是advocacy是一种职业要求,与他们自己的信仰没有关系。For the rest of us, including myself, advocacy is best performed when the lawyer convinces himself. 我觉得必须要把自己放到客户的位置上,去说服自己客户应该赢,只有真正的相信,才能在表达的时候本色演出,让人觉得你是自然的,真实的。

Advocacy在我看来就是律师把自己作为客户的avatar,替客户去做客户自己可能没有能力做的事情,感同身受,才能全力以赴。

除了看气场和自信,陪审团还经常自带究错功能,以此来spot check律师是不是可信,所以一个argument说到什么样的程度,很看律师功力。如果push across the line,就会产生过犹不及的效果。比如opening statement,你告诉陪审团,you will hear no evidence from the plaintiff, absolutely not, thatsupports her sexual harassment theory. 那陪审团就会hold you up forit. 当他们听到trial中原告描述相关情节的时候,他们就会跟自己说,well, here is some evidence。本来呢原告要达到她的burden of proof,是要证明more likely than not sexual harassment occurred,所以她就算有点证据也不见得能赢,但是因为被告的overpromise,使得陪审团觉得被告说的不可信,就是过犹不及了。

说到crossing the line,在这里想和大家分享我最喜欢的好莱坞律师剧之一The Rainmaker里主人公Rudy Baylor的那段话:

"Every lawyer, at least once in every case, feels himself crossing a line that he doesn't really mean to cross... it just happens... And if you cross it enough times it disappears forever. And then you're nothing but another lawyer joke. Just another shark in the dirty water."


这段话,被我贴到了办公室的墙上。

    什么是大“PA“?PA是Partner (合伙人) 的简称。大PA也所谓是律所的Rainmaker,那种能呼风唤雨,为律所创造大利润的大人物。类似于凶猛猎人,在养活自已外,还能养一拨跟班。业绩越好,跟班越多。他们的跟班中还往往包括另一种合伙人,叫Service Partner,那种拉不到客户,靠大PA吃饭的人。当Service Partner风险巨大,因为大PA可以随时抛弃你。因此,做大PA是王道。只有把客户紧抓在手才能掌握和主导自我命运。那怎样成为大PA呢?让我一一叙来。http://bbs.mysipo.com/thread-92640-1-1.html

    每一位律师,在每个案子中至少有一次,都会感到自己已经越过了一条他并非真正想要越过的界限......

    越过界限这件事,只是发生了......

    而且如果你越过界限有足够多的次数,这条界限会永远消失。

    然后你就在另一位律师的段子里出现了:污水中还有另外一只鲨鱼。“
