向USPTO提PPH，其中权利要求需“充分对应”，“充分对应”具体有哪些要求？

在中国提PPH，也有类似地要求吧，有时候非常苛刻

请教一下，CN已经授权，以这个授权版本走PPH进入美国，美国还会出审查意见吗？还是直接授权？

美帝PPH关于充分对应“sufficiently corresponding”的要求非常简单。从实践操作角度而言，远远没有中国要求那么严格（教条）。

首先理论回答：在2014年发布的PPH通知第（3）部分中，对于“充分对应”作出了解释：

3) All claims in the U.S. application for which participation in the Global/IP5 PPH pilot program is requested must sufficiently correspond to the allowable/patentable claims in the corresponding OEE application. Aclaim is considered to sufficiently correspond where, accounting for differences due to claim format requirements, the claim is of the same orsimilar scope as an allowable/patentable claim in the corresponding OEE application. A claim in the U.S. application that is narrower in scope than the claims indicated as allowable/patentable in the OEE application will sufficiently correspond if presented as a claim dependent upon a claim that is of the same or similar scope as a claim indicated as allowable/patentable in the OEE application. In this regard, a claim thatis narrower in scope occurs when an OEE claim is amended to be further limited by an additional feature that is supported by the written description of the U.S. application. Additionally, a claim in the U.S.application that introduces a new/different category of claims than those indicated to be allowable/patentable by the OEE is not considered to sufficiently correspond. For example, where the OEE application containsonly claims relating to a process of manufacturing a product, then any product claims in the U.S. application are not considered to sufficiently correspond, even if the product claims are dependent onproce****laims which sufficiently correspond to allowable/patentable claims in the OEE application.

内容较长，但是其大意就是权利要求范围类似即可。类似包括：权利要求内容完全一致；美帝在后申请权利要求范围更窄（记载额外技术特征）。其不包括权利要求主题变化，比如在先申请是方法，在后申请是装置。

实践操作：提交PPH申请时需要提交权利要求对照表。该表在USPTO网站上就可以下载。并且我这里也附上表格，供大家方便下载。注意：这个表格只是个例子，你可以不用这个表格，可以设计自己的表格。但是由于这个官方表格方便，所以建议使用。在表格第4项中，需要填写对应关系。比如下面的截图。重要的是你要在Explanation项中说明对应关系。说明解释没有官方标准答案，只要能解释清楚就可以。常见的情况包括：修改权利要求符合美帝标准（比如，将characterized in修改为wherein等），消除多项引用。总之，只要符合以上（3）中的原则，基本不会有问题。（当然，PPH不仅要求“充分对应”）对于时间等问题都有具体要求。

另外，虽然美帝专利局对PPH没有额外官费，律所一般对于PPH申请有额外律师费。我们大概是500美元。
